Well I just had a phone call from the very nice Policeman who attended to check up on me and to tell me they want a statement because they are prosecuting.
I don't know if that means he's already admitted liability but I've still got to go through all the hassle of getting it all sorted with the insurers. A courtesy bike won't be much good as I'll probs be out of action for about 6-7 weeks.

If the Police want a statement, I reckon they'll be looking at doing him for 'without due care and attention' or something similar so he'll end up with a fine and points. Regardless, you need the blokes name, address and insurance details so that you can inform your insurers and get the ball rolling to get your wheels sorted. Don't be bullied by the insurance company either. If you bought the bike from a main dealer, tell the insurers you want them to do the repair.. not some backstreet cowboy they may want to nominate.
As the Police are wanting to prosecute, they will undoubtedly have the blokes details and should be able to give them to you so that you can report it to your insurer. Tell the insurer that the Police are looking to prosecute the other driver so they shouldn't quibble. The Police prosecuting the other party means in their eyes, its not your fault.. even if you knew that already

Already contacted the insurers and told them what's going on. One of the paramedics put the chaps details in my jacket ( I keep a copy of mine in there) but the police have them anyway, the Copper told me that from what he seen there is no way it will be getting repaired...

Well.. if it's as bad as the Policeman says, you can look forward to getting your money back (or thereabouts) for the bike which'll give you the option of getting something similar to the same or perhaps moving up in size a wee bit. It seems to me you're lucky to get away with only a broken arm (though I appreciate lucky isn't really an appropriate word). Unfortunately, the roads are full of idiots who don't see things but don't let this put you off getting back on 2 wheels. The odd's are always going to be stacked against us while cars/vans/lorries are allowed to use the same highways so you can't dodge em all

Shock and Horror Mark...What a dreadful business. I hope you recover soon and manage alright on the insurance deal...As the guy is being prosecuted your insurance company will see you right and you won't lose any "No Claims"...While you are getting better, you can start scanning for a new machine...You will possibly find one that you like even more than the old one

Oh ... confession time. I WAS that man. Once.

I pulled my XR3i (tells you the rough date ) out of Cranebank training area at Heathrow on to the dual carriageway. Road was clear so I zipped straight over to the outside lane. A few seconds later and there's a thump as a bike runs in the back. Where the hell did he come from, I thought. And I actually heard myself say to the policeman 'I didn't see him officer.' And there was me with a 750 Honda sitting at home

Mind you, when he woke up, the first thing he said was 'Oh no - not again.' And the policeman rolled his eyes. I was warned that I'd be reported for dangerous driving but in the end I got a nice letter saying that after analysing the accident they decided that he was going too fast and not paying attention. He'd left a very long skid mark before colliding with the rear of an accelerating car and they decided that he was a main contributor to the accident.

It's a horrible feeling, thinking you've been responsible for injuring a biker when you ARE one! But he WAS driving like a twat. Not like Dave and Jonesy who were innocent victims and have my deepest sympathy. Hope the scars heal soon.
